Purpose of TERO
The purpose of TERO is to eliminate discrimination in employment against Native Americans, to create contracting preference for tribal and tribal member owned businesses on tribal land, and to work with contractors and businesses to establish training programs for TERO referrals to increase the pool of qualified employees.
TERO generally governs the contracting provisions between a tribe and any contractor or business and may include provisions concerning:
- Announcing and advertising of jobs
- Indian preference in hiring goals
- Training and skills requirements
- Inspections
- Dismissals and layoffs
TERO does NOT directly hire or make hiring decisions; however, it does refer qualified tribal members and Indians to companies doing business on the Pyramid Lake reservation.
Compliance Plan
A Compliance Plan is a binding agreement between the Pyramid Lake Tribe and a vendor working on tribal lands. Failure to obtain or adhere to the terms of an approved Compliance Plan, or supplying false information to the TERO Office can result in:
- Deny such party the right to commence business within the reservation
- Impose a civil fine of $500 on such party each day out of compliance
- Order the removal of unlawfully hired non-Natives and take action to ensure future compliance
Indian Preference
All covered employers shall give preference to qualified Native Americans and all hiring, promotion, training, layoffs, and all other aspects of employment. To the extent permitted by applicable federal law, preference shall be given in the following order:
- To Pyramid Lake tribal members
- To spouses and descendants of Pyramid Lake tribal members
- To other Native Americans living on or near the Pyramid Lake Indian reservation.
Covered employers shall comply with the rules, regulations, guidelines, and orders of the Pyramid Lake employment right which sets forth the specific obligations of employers regarding native preference.
These requirements shall not apply to any direct employment by the Pyramid Lake Paiute Tribe, the federal, state, or other governments or their subdivisions. It shall apply to all contractors or grantees of such governments and to all commercial enterprises operated by such governments.
Services
Pyramid Lake tribal members, descendants, and spouses of an enrolled Pyramid Lake tribal member, and tribal community members enrolled in a Federally Recognized Tribe are eligible to register with Pyramid Lake TERO.
TERO Applicant Responsibilities
Each individual tribal member must take responsibility for the success of the program.
To establish the credibility of the TERO program and make it work, each person through the TERO program and the tribal members the program places with them. This means:
- Being professional
- Great work ethics and habits
- Showing up on time
- Calling in when you cannot show up
- No excessive absences or tardiness
- Be dependable
- Set a good example
- Be qualified for the job
- Have good “people” skills
- Communicate well
